Terms of Service

1. Introduction

Welcome to BuildOurHome (the "Service"), a 3D home design application operated by CustomWare ("we," "us," or "our"). By accessing or using the Service, you agree to these Terms of Service.

2. The Service

BuildOurHome is built on the open-source Pascal Editor, which is released under the MIT License. The BuildOurHome platform and its associated services — including user accounts, cloud storage, projects, and AI-powered features — are operated by CustomWare and are governed by these Terms.

You may use the Service free of charge. We may introduce paid plans or metered features in the future; if we do, the applicable pricing and terms will be presented to you before you incur any charge.

3. Accounts and Authentication

You can start designing without an account. To save your work to the cloud and access it across devices, you must create an account. We support email and password, Google sign-in, and magic-link email authentication. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

4. AI Features

BuildOurHome offers optional AI features, such as restyling a view of your design and generating short videos, powered by third-party AI providers. When you use these features, the relevant image or view from your design is sent to those providers to produce the result. You must only submit content you have the right to use, and you are responsible for how you use the generated output. AI output may be imperfect and is provided without warranty.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Upload, share, or distribute content that infringes intellectual property rights
• Attempt to gain unauthorized access to the Service or its systems
• Interfere with or disrupt the Service's infrastructure
• Upload malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Use the Service to send spam or unsolicited communications

6. Your Content and Intellectual Property

You retain full ownership of all content, projects, and data you create or upload to the Service ("Your Content"). By using the Service, you grant us a limited license to store, display, process, and transmit Your Content solely to provide the Service to you — including sending the relevant view to AI providers when you choose to use an AI feature.

We do not claim any ownership rights over Your Content. You may export or delete Your Content at any time.

7. Service Ownership

The BuildOurHome platform, including its design, branding, and proprietary features, is owned by CustomWare and protected by intellectual property laws. While the underlying Pascal Editor is open-source under the MIT License, the BuildOurHome platform services, branding, and infrastructure remain our proprietary property.

8. Account Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to the Service or other users. You may also delete your account at any time by contacting us at david.vykopal@cstmware.com.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUSTOMWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
